After seeing the video I don't think Stewart hit the kid on purpose. I think it was a mistake on both parties that unfortunately killed a kid. Stewart should know better but it's tough to say what was going through his mind and what he saw. The kid should not have gotten out of his car and walked in the middle of the track in a night race wearing black! I mean cars aren't as predictable to control as asphalt. Dumb all around. I pretty sure Stewart won't receive any jail. Fines, probation, community service, sued for a good chunk of change and a suspension.

There's actually two different videos of the crash. Well it might be the same one, but I'm guessing that whoever copied the first one, somehow the frame/audio got out of sequence. You can see/hear the rev of the engine occurs at different times.

Another driver in the sprint-car race in which the car of NASCAR star Tony Stewart struck and killed fellow racer Kevin Ward Jr. while Ward was on foot said he passed Ward moments before the fatal incident.
After contact with Stewart's sent Ward's car into the fence, Ward climbed out and walked on the track at Canandaigua Motorsports Park in upstate New York on Saturday night.
While apparently gesturing angrily toward Stewart as the cars circled back around the dirt track, Ward, 20, was struck by Stewart's car.
Moments earlier, "I drove right by him," driver Paul Kinney told NBC News, referring to Ward. "He looked a little bit angry. I didn't think much of it. A lot of drivers do that."
Kinney said it was "obviously not a racing incident. It's not a good idea to get out of your car and run toward other cars. But nobody can speak for Tony. Only Tony knows exactly what happened."
Kinney added that as he passed by Ward, "I seen Kevin clear as day. Nobody else ran into him, either."
Amateur video of the incident has sparked widespread public debate about who might have been at fault. Kinney said he watched the video once and does not want to see it again.
Local authorities reiterated Monday that there were no criminal charges pending against Stewart but that their investigation continues.
Stewart has not commented publicly on what happened but issued a statement saying, "There aren't words to describe the sadness I feel about the accident."
Funeral services for Ward were scheduled for Thursday at a high school in Turin, N.Y.

A sprint car driver from Brookfield, WI was killed tonight up at a race in Beaver Dam. He flipped his ride in practice and went into the wall though I presume the wall went into him like the IRL cat a few years ago. That sucks.

Felonious Tony will find out today!
An Ontario County (N.Y.) grand jury has made a decision on whether to charge Tony Stewart in the death of Kevin Ward Jr., and that decision will be announced at 3 p.m. ET by District Attorney Michael Tantillo.
A prosecutor needs 12 of the 23 grand jury members to recommend charges in order to obtain an indictment.
